Terms of Use - nixers
1. Who These Terms Are With
- Contracting Entity: These terms are between you and Factory X Limited (trading as nixers.com), company number 790278, registered address 1 Adelaide Villas, Adelaide Road, Glenageary, Co. Dublin, A96 V2T8 ("nixers", "we", "us").
- Contact: hi@nixers.com. A person reads that inbox.
- Privacy Notice: Our privacy notice at https://nixers.com/privacy explains what we do with your personal data. Please read it alongside these terms.
- Agreement: When you create an account or post a job, you tick a box that says "By continuing you agree to our Terms and Privacy Notice". By ticking it, you agree to these terms. If you do not agree, do not create an account or post a job.
- Eligibility: You must be 16 or over to use nixers. If we learn that someone under 16 has an account, we will close it. If you post a job, you must be entitled to hire for it, or to post it for the business that is hiring.
2. What nixers Is, and What It Is Not
- Service Overview: nixers helps people in Ireland find work. You can browse jobs, chat with the nixers job assistant, add your CV to build a profile, get job alert emails, use Help me apply, turn on Apply for me to send applications to jobs you choose, apply for jobs posted on nixers, and open a search link on another Irish job site if you ask. Anyone hiring can post a job, by typing it or recording it by voice.
- Not an Agency: nixers is not an employment agency, a recruitment business or an employer.
- Fees: Job seekers pay nothing. Posting a job is free. We do not charge employers unless a separate written agreement says so.
- Payments: We do not handle any money between job seekers and employers.
- No Vetting: We do not vet or background-check the people who post jobs or the people who apply.
- Listing claims: nixers does not verify claims made in listings.
- No Guarantee: We do not guarantee that a job is real, still open, or pays what it says, or that you will get it.
- The Deal Is Between You and the Employer: Any job or contract is between you and the employer, not nixers. Check who you are dealing with, and agree the pay, hours and conditions before you start work.
3. The nixers Job Assistant
- What It Does: The assistant uses what you tell it and what is in the listings to show you jobs on nixers that fit. To do that it sends what you type to our provider OpenAI. Job titles, pay, employers, and links come from the listings, not from the assistant's own wording.
- Other job sites: if you ask, the assistant may give you a link to a search on jobs.ie, indeed.ie, or irishjobs.ie. We do not send them your details. What you do there is between you and that site. nixers does not apply for you there either.
- Nothing Invented on Purpose: It is built not to make up jobs, pay, employers or qualifications. If a listing does not say something, it should tell you it does not know.
- It Can Still Get Things Wrong: It is software. Before you rely on it, check the job listing, and the employer's own page for Sourced and imported jobs.
- Tell the Truth: Give accurate information about yourself. Do not ask the assistant, or Help me apply, to add qualifications, tickets or experience you do not have.
- Matches Are Suggestions: When nixers says a job matches, it means the listing fits what you told us. It is not a job offer and does not mean the employer will hire you.
4. Your Account
- Browsing: You do not need an account to browse jobs, chat with the assistant, or post a job.
- Features That Need an Account: Uploading a CV and saving your profile, seeing your matches, job alert emails, Help me apply, Apply for me, your applications list, and messages.
- Signing In: You sign in with your email address and a password. Keep your password safe and do not share it. You are responsible for what happens on your account. If you think someone else has used it, reset your password and tell us at hi@nixers.com.
- Applying Without an Account: If you apply for a job posted on nixers without an account, we create one with your email address and email you a link to sign in.
- One Account Each: Use an email address you own. One account per person.
5. Your CV and Profile
- Searching: You can narrow a search by things like the kind of work, the area and the lowest pay you want.
- CV Upload: You can upload a CV as a PDF, DOC or DOCX file, up to 4 MB. We read it and pull out details to build your profile, and show them to you to check. Correct anything that is wrong before you rely on it.
- Your Own CV Only: Only upload your own CV. If it includes other people's details, such as referees, only include them if you are happy for us to hold them. You can leave referees off.
- Your Profile Is Private: We do not show your CV or profile to employers. When you apply for a job on nixers, the employer gets only what you write in your application. If you use Apply for me, the employers you choose get your CV and apply profile details (section 7A).
6. Job Emails
- Job Alerts: Job alert emails are off until you turn them on in Settings. You choose how often ("As they are posted" or "Once a day") and which kinds of work. We send at most 3 alert emails a day, and none when nothing new fits.
- Stopping Them: Every alert email includes an unsubscribe link. You can also turn alerts off in Settings at any time.
- Service Emails: We also send emails you need to use nixers, such as sign-in and password emails, and emails about your applications or job posts.
- No Marketing: We send jobs, not marketing. We do not promise that any particular job will appear, or that an email arrives at a particular time.
7. Help Me Apply
- nixers Drafts, You Send: Help me apply writes a draft using your confirmed profile and what you told us. Read it, change it, and decide whether to use it. Nothing on that page is sent for you.
- Your OK First: We never send your details to an employer without your OK for that job.
- You Are Responsible for What You Send: Check that what you send is true and complete.
- Sourced and Imported Jobs: For these jobs you apply on the employer's own site, through the "Apply on" link. Opening that link sends nothing from us and is not an application. What you give the employer there is covered by their terms and privacy notice, not ours.
- Jobs Posted on nixers: If you apply through nixers, your application goes to the person who posted the job. We have not checked who they are, so do not send documents or details you would not give a stranger.
- Help Me Apply Does Not Send: Help me apply does not apply for jobs for you. A draft in the assistant works the same way: you read it, you send it, and we do not send it for you. Apply for me is separate (section 7A).
- Limits: To stop spam, there are daily limits on how many applications and messages you can send.
7A. Apply for Me
- What It Does: If you turn it on, nixers fills in and sends employers' application forms for the jobs you tick, using your apply profile, your CV and the cover note you check. Tapping Send is your instruction to send every job in that batch. We wait 5 minutes before sending, and you can tap Stop during that time. We do not show you each form first.
- Your Promises: The details in your apply profile are true and yours, and you are applying for yourself. Keep them up to date.
- Nothing Invented: We only use what you gave us. If a form asks something we have no answer for, we do not send it and mark it "Needs you - not sent".
- Employer Terms: Where an employer's form requires you to accept their own terms or privacy notice to apply, you authorise us to tick that box for you. Marketing boxes are never ticked.
- Sites That Need You: We do not log in as you, create accounts on other sites, get around "prove you're human" checks, or ignore a site's terms or robots.txt file. Those jobs are marked "Needs you - not sent".
- Under 18: If you are under 18, or have not told us you are 18 or over, we do not send applications for jobs that need you to be 18 or over, such as bar or alcohol service, security, driving or late-night work.
- Limits: Up to 5 jobs a batch, 10 a day, and 2 to the same employer a week. We can pause the feature, or one site, at any time.
- Once It Is Sent: We cannot recall an application. To withdraw, contact the employer. Your application is then between you and the employer, as in section 2.
- No Guarantee: A confirmation means the employer's site accepted the form. It does not mean anyone has read it, or that you will get the job.
8. Sourced and Imported Jobs
- Sourced Jobs: Jobs marked "Sourced" were found by our team on the employer's own public careers page. The employer did not post them on nixers and has not endorsed nixers.
- Imported Jobs: We also import jobs automatically from public job pages on recruitment systems that employers use. Today most come from Rezoomo. Others come from Oleeo (Dunnes Stores), HireHive (Focus Ireland), Workable (CrewLink) and Oracle (An Post). These jobs show "Apply on" followed by the source. An imported job comes off nixers when the source stops listing it, or when we cannot reach the source for 7 days.
- The Employer's Page Comes First: The employer's own page is the source of truth. A Sourced or imported job may be out of date or already filled.
- Applying: You apply on the employer's or source's site, or by phone or text when the listing says so. We do not take applications for Sourced or imported jobs, and we do not hold a named contact person. An employer business number may be shown only after you tap to reveal it, and nixers never calls or texts for anyone.
- Takedowns: If you are the employer, or you are named in a listing, email hi@nixers.com and we will remove it within 24 hours of your request. Employers can also stop imports of their jobs at nixers.com/index-opt-out.
9. Posting a Job
- Your Promises: When you post a job, you promise that:
- You are entitled to advertise it.
- It is accurate: the work, pay, hours and place are as described. You can mark pay or location "Not specified", but nothing in the job may mislead.
- It is lawful, including the Employment Equality Acts 1998-2021 (no discriminatory ads), the National Minimum Wage Act 2000, and the Protection of Young Persons (Employment) Act 1996.
- Anything you include about other people, you are allowed to share.
- Publishing Your Job: You allow us, free of charge, to publish your job on nixers, show it in search, matches and the assistant, and include it in job alert emails to people whose choices it fits. This lasts while the job is on nixers.
- How Long It Stays Up: A job posted by voice comes off the board after 7 days. A typed job stays up until you take it down or we remove it.
- Posting Without an Account: You get two links: one opens your applications, the other takes the job down. Keep them safe, as anyone with the takedown link can remove the job. If you lose the takedown link, email hi@nixers.com. We will only send a new link to the reply address on the job, after you show us you control that address.
- Recording a Job by Voice: Recording is the default way to post. You can type instead.
- We only record after you agree on the consent card.
- Your recording is sent to our provider OpenAI to turn it into text and pick out the job details (role, place, pay and time), and the text is checked for harmful content. You check the details before the job goes up.
- If you use the live voice conversation, our provider ElevenLabs runs it, and your answers to its questions are processed to fill in the job. You then record a short description.
- Your own recording is published on the job so people can hear it. You allow us to publish it for as long as the job is on nixers. Do not include your home address, PPS number or anything you would not put on a poster.
- The takedown link deletes your recording along with your reply address. Otherwise, we delete the recording and its text 90 days after the job comes off the board, or 30 days after it is hidden by moderation. See our privacy notice.
10. What Is Not Allowed
- Do Not:
- Post fake, fraudulent or non-existent jobs.
- Advertise jobs you are not entitled to advertise.
- Post anything discriminatory, harassing, defamatory or unlawful.
- Collect other people's details, or scrape nixers.
- Pretend to be someone else.
- Try to get the assistant to produce false, malicious or harmful content.
- Use nixers to sell anything other than genuine work.
- How We Check: Voice recordings are checked automatically for harmful content, and a flagged job is hidden. You can report any job, and a person reviews reports.
- What We Can Do: We may hide or remove content, and suspend or close accounts, that break these terms.
- Telling You Why: If we hide your content or suspend your account, we will email you the reason and tell you how to appeal.
- Appeals: If you think we got it wrong, email hi@nixers.com. A person will review the decision and reply within 14 days.
11. Our Side of It
- The Service: We try to keep nixers working and accurate, but it is provided "as is" and "as available". We do not promise it will always be available or free of errors. We may change, pause or stop any feature.
- Our Liability: Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Nothing in these terms takes away your statutory rights as a consumer. Otherwise, we are not liable for indirect or consequential losses, or for anything that happens between you and an employer or job seeker.
- Law and Courts: These terms are governed by Irish law, and the Irish courts deal with disputes. If you are a consumer living elsewhere in the EU, you keep the protections of the law where you live.
12. Stopping
- Stopping Use: You can stop using nixers at any time. Turn off job alert emails in Settings or with the unsubscribe link in any alert email.
- Closing Your Account: Closing an account is a manual request by email to hi@nixers.com from your account email address. There is no close-account button in Settings. A person actions the request within 7 days, using the closure script.
- What Happens to Your Data: We keep your information while your account is open. Within 7 days of that request, the closure script deletes your profile, CV file and CV text, Help me apply drafts, apply profile, Apply for me history (what was sent, screenshots and confirmations), job email settings and applications list. The short record of each batch you approved (when, which jobs, a cover note fingerprint, no application content) is kept for 6 years.
- Jobs You Posted: When we action the closure, jobs you posted stay on record without your name or reply address, until 12 months after the job ends.
- Records We Must Keep: We keep records of your consent, of your agreement to these terms, and of each Apply for me batch you approved, for 6 years, as proof. Our privacy notice has the full list of how long we keep things.
- Messages: Within 7 days of that request, the text of messages you sent through nixers is wiped. The other person's own messages stay in their inbox.
13. Changes
- Updates: We may update these terms. When we do, we will post a notice on the site, publish the new version on this page and change the last updated date below.
- Material Changes: We may update these terms. If a change is material, signed-in users will be asked to review and accept the updated version the next time they log in, before continuing. The Last updated date shows the current version.
